Terms of Service

• "Service" means the MAttendance web application, mobile application, APIs, and all related features.
• "Organization" means the business entity that subscribes to the Service.
• "Administrator" means a user with administrative access to manage the Organization's account.
• "Employee" means an end-user who uses the Service to record attendance.
• "Content" means all data, records, and information submitted to the Service by your Organization.

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials. You must notify us immediately at support@mattendance.com if you suspect unauthorized access to your account.

You must be at least 18 years of age to use the Service. By using the Service, you represent that you meet this requirement.

Access to the Service is provided on a subscription basis. Subscription fees are billed according to the plan you select, which is priced per employee per month. Fees are non-refundable except as expressly stated in these Terms or required by applicable law.

We reserve the right to change pricing with at least 30 days' notice. Continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.

If payment fails, we may suspend access to the Service after reasonable notice. Accounts that remain unpaid for more than 30 days may be terminated and data may be permanently deleted.

We offer a 14-day free trial with no credit card required. At the end of the trial, you may choose a paid plan to continue using the Service. If you do not subscribe, your account and associated data will be retained for 30 days after the trial ends, then permanently deleted.

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Collect or process personal data without appropriate legal basis or consent.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Introduce malware, viruses, or any malicious code.
• Interfere with the Service's availability or performance.
• Reverse engineer, decompile, or attempt to extract source code from the Service.
• Resell or sublicense the Service without our written permission.

You retain ownership of all Content you submit to the Service. By submitting Content, you grant us a limited license to store, process, and display it solely to provide the Service to you.

You are responsible for ensuring that your collection and use of employee data (including biometric data, GPS data, and attendance records) complies with all applicable laws, including obtaining necessary employee consent.

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

The Service, including its software, design, features, and documentation, is owned by MAttendance and protected by intellectual property laws. These Terms do not grant you any rights to use MAttendance trademarks, logos, or brand identifiers.

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance at any time. We will make reasonable efforts to notify you in advance of planned downtime.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free or that results obtained from it will be accurate or reliable.

To the maximum extent permitted by law, MAttendance shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate your account if you violate these Terms, fail to pay applicable fees, or if we are required to do so by law. Upon termination, we will provide you a reasonable opportunity to export your data before it is deleted.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.

We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 14 days before they take effect. Continued use of the Service after that date constitutes your acceptance of the updated Terms.
